AI and patent applications

Artificial intelligence has really made its way into the patent world. The tools are getting better and better, and many people are finding that AI can be of great help when drafting a patent application.

AI can contribute with better language, clearer formulations and more alternative embodiments of the invention. For many inventors and companies, this provides a good first draft of a patent application, and in some cases the result can actually be better formulated than what was previously possible without such tools.

At the same time, it is important to understand what AI is good at – and what it is not so good at.

Language is not the same as patent strategy

A patent application is not just about describing an idea in a good way. It must also be designed to provide the best possible protection for the invention and the business idea behind it.

AI can be very good at structuring text and improving language, but it often has limited understanding of the strategic side of patenting. It doesn't necessarily know which technical features are crucial for protection, how the claims should be structured, or how the invention should be delimited from existing technology.

If these assessments are not done correctly from the start, the result may be an application that looks good on paper but provides weak or little valuable protection.

The patent claims are the core of the application.

The most important part of a patent application is the patent claims. These are what define what the invention actually grants exclusive rights to.

Small wording in the claims can have big consequences for how broad or narrow the protection will be. If the claims are worded too narrowly, competitors can easily develop solutions that circumvent the patent. If they are worded too broadly, the Norwegian Patent Office or other patent authorities can reject them for not being new or inventive enough.

This is an area where experience and technical understanding are often crucial.

The importance of alternative designs

A good patent application usually contains several alternative ways of implementing the invention. These serve as so-called "fallback positions" if the patent claims later need to be limited during the proceedings.

If such options are not described in the original application, it may be impossible to add them later. The result may be that the application loses much of its value if the requirements have to be adjusted.

AI can help generate multiple variants of a solution, but it still requires professional judgment to ensure that they actually provide strategic value in the patent process.

The best solution: AI combined with expertise

AI is a powerful tool, and when used correctly, it can make patent applications faster and better. Many inventors therefore use AI as a first step in the process of describing their invention.

The best solution is often to combine AI with experienced IP advisors. This allows you to leverage the benefits of AI while ensuring the application is strategically and technically quality assured.

The result is a patent application that is not only well written – but also provides the best possible protection for the invention and the business idea behind it.
