How Equip handles your contact details
This page and our general privacy policy
This page covers one thing: the letters we send about Norwegian trade mark refusals, and the contact details behind them. Our general privacy policy, in Norwegian, covers clients and visitors to equip.as and is linked from this site.
Who we are
Equip AS, organisation number 933 591 298, and Equip Advokat AS, organisation number 926 403 915 (together "Equip"), Herslebs gate 2 b, 0571 Oslo, Norway. Questions about this notice, or about your details: andreas@equip.as.
Why you received a letter from us
Patentstyret, the Norwegian Industrial Property Office, publishes the provisional refusals it issues against international trade mark registrations designating Norway. We read that register. Where a refusal has been issued and no Norwegian representative is recorded on the case, we write to the representative recorded for the holder before the World Intellectual Property Organization, to say so and to offer to act.
One letter, about one case, with a deadline in it. That is the whole purpose.
What we hold about you
• your name, your firm, and your professional postal address, as recorded in the international register
• your work email address
• the case facts: the international registration number, the mark, the holder, the refusal and its grounds, the deadline, and the earlier marks cited against it
• whether we have written to you before, and what you replied
Where it came from
We did not get your address from you, so this is the part of this notice that matters most:
• WIPO's Madrid Monitor - the international register, which records the representative for each international registration together with their postal address
• Patentstyret's register and case files - the refusal itself, the mark, the holder and the cited earlier rights
• your firm's own website, or an official register of attorneys (for example the German Patentanwaltsregister, the Polish patent attorney register, or a national IP office's own list of representatives), where the international register records no email address
We do not buy contact data, and we do not take it from contact brokers or data aggregators.
Our legal basis
Legitimate interests, GDPR Article 6(1)(f): our interest in offering legal services to a professional handling a matter with a Norwegian deadline, balanced against your interest in not being written to. We have written that balancing down and will give you a copy if you ask.
You can tell us to stop, and that is the end of it
You have an absolute right to object to direct marketing (Article 21(2)). Reply "no letters" to the email, or write to andreas@equip.as. We record the objection against you and your firm and we do not write again. We act on it within 10 business days, and in practice the same day.
You also have the right to ask what we hold about you, to have it corrected or erased, and to restrict how we use it. If you think we have handled your details badly you can complain to Datatilsynet, the Norwegian Data Protection Authority (datatilsynet.no), or to the supervisory authority where you live.
How long we keep it
• the contact record, including that we wrote to you: five years from our last contact with you, after which it is deleted
• an objection, or a request not to be contacted: kept indefinitely, for the single purpose of making sure we never write to you again. Deleting it is how firms end up contacting the same person twice.
Who else sees it
Nobody outside Equip. Your details sit in our own files and in our email system, Microsoft 365, which processes them on our instructions. Our mailbox data is stored in Norway. We do not share your details, and we do not use them for anything but the letter described here.
Automated decisions
None. A person decides every letter that is sent, and reads every reply.
